Terms of Service

The short version. Use Wombat VPN for lawful things. Subscriptions and refunds are handled by Google Play and the Apple App Store, not by us. We run the service carefully but provide it as-is, with no promise that it is never slow or never down. We may cut off access that is being used to attack or harm others. Italian and EU law applies.

1. Agreement

These terms are the agreement between you and Wombat VPN for use of the Wombat VPN apps and this website (together, the “Service”). By installing or using the Service you accept them. If you do not accept them, do not use the Service — and since there is no account to close, uninstalling the app is enough to walk away.

2. What the Service is

Wombat VPN routes your device's internet traffic through an encrypted WireGuard tunnel to one of our servers, from which it reaches the internet. It is a privacy and security tool. It is not an anonymity guarantee, not a way to make you untraceable, and not a shield against being identified by services you deliberately log into.

The Service requires no account. Your device authenticates with a WireGuard key pair generated on the device, as described in our Privacy Policy.

3. Acceptable use

The rule is simple: do not use Wombat VPN to break the law or to harm other people or networks. Specifically, you agree not to use the Service to:

  • carry out any activity that is illegal under the laws that apply to you or to the country where the server you use is located;
  • attack, disrupt or gain unauthorised access to any system or network — including port scanning, intrusion attempts, denial-of-service traffic, credential stuffing or malware distribution;
  • send spam or bulk unsolicited messages, or operate open relays or proxies for third parties;
  • infringe copyright, trademarks or other intellectual property rights;
  • distribute or access child sexual abuse material, or any content whose possession is a criminal offence;
  • harass, threaten, defraud or impersonate anyone;
  • resell, sublicense or share the Service commercially, or circumvent any technical limit, fair-use measure or subscription check.

You are responsible for what happens through your device and its key, including anything done by someone else you allowed to use the device.

4. Subscriptions, billing and refunds

  • Paid plans, when available, are sold and billed exclusively through Google Play or the Apple App Store. We never handle your payment details.
  • Subscriptions renew automatically until cancelled. You cancel through your Google Play or Apple subscription settings — not through us, because we have no account of yours to cancel.
  • Refunds are governed by the store's own policy and are requested from the store. Since we do not process the payment, we cannot issue a refund ourselves, and we have no record identifying your purchase.
  • Prices and plan contents may change. Changes apply from the next billing period, announced through the store or in the app before they take effect; if you do not want a new price, cancel before renewal.
  • Nothing here removes the rights EU consumer law gives you.

5. Availability and fair use

We work to keep the Service fast and available, but we do not promise uninterrupted service or any particular connection speed. Servers need maintenance, networks have bad days, and capacity in a given location is finite. We may add, move or retire server locations as the fleet changes.

We may apply reasonable measures to keep the Service usable for everyone — for example limiting the number of devices provisioned from one subscription, or throttling behaviour that degrades a shared server.

6. Provided “as is”

The Service is provided as-is and as-available, without warranties of any kind, express or implied, including fitness for a particular purpose and non-infringement. You use it at your own risk and remain responsible for your own security decisions. To the extent permitted by law, we are not liable for indirect, incidental or consequential damages, for loss of data or profits, or for anything arising out of use of the Service. Where liability cannot be excluded, it is limited to the amount you paid for the Service in the twelve months before the event. Nothing in these terms limits liability for fraud, gross negligence, wilful misconduct, or anything else that cannot be limited under applicable law.

7. Suspension and termination

We may suspend or terminate access to the Service, without notice where the situation demands it, if it is being used in breach of section 3 — typically by revoking the offending device key. Serious or repeated abuse means permanent loss of access. Where abuse relates to a paid subscription that we terminate for cause, no refund is due beyond what the store's policy or the law requires.

You may stop using the Service at any time by revoking your device key in the app and uninstalling it.

8. Changes to these terms

We may update these terms as the Service evolves. The effective date at the top always reflects the current version, and material changes will be announced in the app before they take effect. Continuing to use the Service after a change means you accept the updated terms.

9. Governing law

These terms are governed by Italian law, within the framework of European Union law, and the courts of Italy have jurisdiction over disputes. If you are a consumer resident in the EU, this does not deprive you of the protection of the mandatory consumer-protection rules of your own country, and you may bring proceedings in your place of residence.
